<h4>Preliminary remarks</h4>
<p>GVL Auto, based in 4055 Pucking, offers consultation, negotiation, sale, and contract processing services related to automobiles. GVL Auto provides expertise in these areas and is committed to assisting customers in finding the perfect car, including negotiation with dealers and collaboration with partners for further negotiations. Additionally, GVL Auto extends its services to include the offering of vehicles and associated accessories. This document outlines the terms and conditions for the new scope of services.</p>
<h4>Scope</h4>
<p>These General Terms and Conditions for Consultation, Negotiation, Sale, and Contract Processing ("GTCs") apply to the customer's engagement with GVL Auto. GVL Auto reserves the right to amend these GTCs, with any changes communicated to customers at least 1 month before their effective date. The customer's acceptance of these GTCs is required before engaging in any services offered by GVL Auto. The agreements with GVL Auto are conducted in German or English.</p>
<h4>Conclusion of an agreement: Offer and offer acceptance</h4>
<p>GVL Auto's services, including consultation, negotiation, and sale, are invitations for customers to place a binding offer. The customer can engage in these services through various means, such as email and online forms. Depending on the specific service the customer wishes to avail, a corresponding offer will be provided outlining the details and terms. Once the customer accepts the proposal, GVL Auto initiates the service, commencing the agreed-upon tasks, and subsequently issues an invoice for the rendered service.</p>
<h4>Subject matter of the services</h4>
<p>GVL Auto provides consultation, negotiation, and sale services for automobiles and related products, including the handling of contracts and data sharing with dealers and partners for negotiations. The customers, GVL Auto as well as partners of GVL Auto are responsible for keeping access data confidential. GVL Auto's services are manufacturer-independent and tailored to the customer's specified preferences and budget.</p>
<h4>Granting of rights (intellectual property, secrecy, confidentiality)</h4>
<p>Customers are granted non-exclusive, non-transferable rights to use the services for their own purposes. Commercial use is prohibited. All documents and materials provided by GVL Auto are protected and should be treated as confidential. The customer and participants are not granted exclusive rights to this information, and transmission or reproduction is not permitted.</p>
<h4>Dates and times of the services</h4>
<p>The timing of services, including consultation and negotiation, will be communicated to the customer. Changes to schedule times may occur if necessary, with GVL Auto providing alternative dates if required.</p>
<h4>Service fees, terms of payment, cancellations</h4>
<p>Fees for services are communicated to the customer, and payment terms apply. Cancellation policies vary based on the type of service, with fees applicable for cancellations. GVL Auto reserves the right to charge additional costs for individual individual circumstances on the part of the customer.The cancellation policy stipulates that a withdrawal is only possible until the commencement of services by GVL Auto. Once GVL Auto initiates the agreed-upon activities following the acceptance of the customer's offer, service cancellations are permissible only through the complete payment of costs for the services to be canceled by the customer.</p>
<h4>Warranty and liability</h4>
<p>GVL Auto is not liable for non-performance or delayed performance due to circumstances beyond its control. Liability for damages is limited to willful intent or gross negligence. Customers are responsible for securing their data and systems during services provided by GVL Auto.</p>
<h4>Privacy Policy</h4>
<p>The processing of personal data for the offered services is integral to GVL Auto's operations. Customer data is handled according to applicable data protection regulations, and all communications are conducted via secure, self-hosted IT infrastructure. In specific instances where data may need to be shared with third parties or partners, GVL AUTO ensures that this will only happen after obtaining separate contractual consent from the customer. Customers have the right to decide and must provide explicit agreement before any data sharing occurs with external entities. This additional consent step ensures transparency and gives customers control over the extent of data sharing.</p>
<h4>Right of revocation, revocation instruction</h4>
<p>For consumer agreements, a right of revocation may apply. The right of revocation is excluded if GVL Auto has started and completed the service at the customer's request.</p>
<h4>General provisions, place of jurisdiction</h4>
<p>These GTCs constitute the entire agreement between GVL Auto and the customer. Amendments require written consent. Austrian law applies, and the place of jurisdiction is 4055 Pucking for consumers. For enterprises, the place of jurisdiction is agreed upon at GVL Auto's discretion. If any provision is invalid, the remaining provisions remain in effect.</p>
